1. Definitions
For the purposes of these Terms and Conditions:
- "Bodhi Legal" / "We" / "Us" / "Our" refers to the legal practice operating under that name at 145 Wireless Road, Lumpini, Pathum Wan, Bangkok 10330, Thailand.
- "Services" refers to the legal and advisory services offered by Bodhi Legal, including initial consultations, document preparation, and full defence engagements as described on this website.
- "User" / "You" / "Your" refers to any individual accessing this website or engaging our Services.
- "Agreement" refers to any engagement letter or written terms agreed between Bodhi Legal and a client for the provision of specific Services.
- "Website" refers to the site accessible at this domain.
2. Acceptance of Terms
By accessing this website or engaging Bodhi Legal's Services, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and accept these Terms and Conditions in full.
If you do not agree to these Terms, please do not use this website or engage our Services.
3. Service Description
Bodhi Legal provides legal advisory and representation services focused on pension matters in Thailand. Services are delivered in English and are principally directed at individuals with pension entitlement questions or disputes arising under Thai law.
Services are available to clients resident in Thailand and abroad. Remote consultations and document services are available; certain formal proceedings may require the client's physical presence in Thailand as determined by the relevant authority.
Availability of specific services may vary. We reserve the right to decline instructions where a conflict of interest exists or where the matter falls outside our practice area.
4. User Responsibilities
You agree to use this website and our Services in a lawful manner and to:
- Provide accurate, complete, and truthful information when making enquiries or during a matter
- Notify us promptly if any information provided changes materially
- Not misuse this website, including by attempting to gain unauthorised access to any part of it
- Not reproduce, redistribute, or commercially exploit content from this website without our written consent
5. Intellectual Property
All content on this website — including text, design, and structure — is the property of Bodhi Legal and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to view and access this website for personal, non-commercial purposes.
Documents prepared by Bodhi Legal for a client are provided for that client's use in connection with the matter for which they were prepared. They may not be repurposed, shared publicly, or used in other proceedings without our written consent.
6. Payment Terms
Fees for Services are set out on this website and in the engagement letter agreed with each client. All fees are quoted and payable in Thai Baht (THB). Payment is required in accordance with the terms of the engagement letter before work begins, unless otherwise agreed in writing.
Disbursements (such as government filing fees or third-party costs) will be communicated to you in advance and are payable separately from the service fee. No disbursement will be incurred without your prior written authorisation.
Refund policy: Fees paid for a consultation are non-refundable once the session has been conducted. Fees paid for the Document Preparation Package or Full Defence Engagement may be refunded in part if work has not yet commenced, as set out in the relevant engagement letter.
7. Service-Specific Terms
The scope of each service is defined in the engagement letter issued to the client. In general:
- The Initial Consultation covers the session itself; no ongoing advisory or representation obligation arises from this service alone.
- The Document Preparation Package covers drafting, review, and delivery of the documents specified in the engagement letter; it does not include attendance at hearings or appellate work.
- The Full Defence Engagement covers proceedings from administrative review through to appellate conclusion where applicable; scope is defined per engagement.
Any scope change must be agreed in writing. We will not extend the scope of an engagement without your prior authorisation.
8. Disclaimers
This website is provided for informational purposes. The content on it does not constitute legal advice. A solicitor-client relationship arises only upon the execution of an engagement letter.
Legal proceedings are subject to inherent uncertainty. Bodhi Legal makes no representation regarding the outcome of any matter. Our obligation is to provide competent, diligent, and honest legal services — not to achieve any particular result.
9. Limitation of Liability
To the extent permitted by law, Bodhi Legal's liability arising from or in connection with the provision of Services is limited to the total fees paid by the client for the specific service giving rise to the claim.
We are not liable for indirect, consequential, or special losses, or losses arising from factors outside our reasonable control (including changes in law, decisions of regulatory bodies, or force majeure events).
10. Indemnification
You agree to indemnify Bodhi Legal against any claims, losses, or expenses arising from your breach of these Terms, your misuse of this website, or the provision of false or materially misleading information to us in connection with a matter.
11. Termination
Either party may terminate an engagement by written notice, subject to the terms of the relevant engagement letter. Bodhi Legal reserves the right to terminate an engagement with immediate effect where a client provides false information, creates a conflict of interest, or behaves in a manner that makes continued representation inappropriate.
Upon termination, you remain liable for fees for work completed to the date of termination. Clauses covering intellectual property, limitation of liability, and dispute resolution survive termination.
12. Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising from or in connection with these Terms or the provision of Services shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.
Before initiating formal proceedings, both parties agree to attempt to resolve any dispute through good-faith discussion for a period of 30 days from the date of written notice of the dispute.
13. General Provisions
These Terms, together with any engagement letter, constitute the entire agreement between the parties in respect of their subject matter. If any provision is found to be unenforceable, the remaining provisions continue in full force. A failure to enforce any provision does not constitute a waiver of the right to enforce it in the future.
Bodhi Legal may not assign its obligations under an engagement without your prior written consent. You may not assign your rights under an engagement without our prior written consent.
14. Changes to These Terms
We may update these Terms from time to time. Changes will be effective from the date the updated Terms are published on this page. Where changes are material, we will take reasonable steps to notify users. Continued use of this website following publication of updated Terms constitutes acceptance of those Terms.
