Case Study 1
Pension recalculation — incorrect service period applied
A retired civil servant discovered that a three-year period of qualifying service had been excluded from the calculation of their government pension benefit. Prior correspondence with the relevant office had produced no resolution over an 18-month period.
Our Approach
Bodhi Legal was engaged under the Document Preparation Package. We reviewed the original employment records, identified the administrative error, and prepared a formal written submission with supporting affidavit and covering letter addressed to the reviewing authority.
The Outcome
The submission was reviewed and the recalculation approved within seven weeks. The corrected pension reflected the full qualifying service period. "It was resolved more quickly than I expected. The submission clearly made the position understandable."
Case Study 2
Full defence — pension benefit denial following employment reclassification
Following a retroactive reclassification of employment status by a former employer, the client's pension entitlement was denied entirely. The matter was already at the administrative review stage when Bodhi Legal was approached.
Our Approach
A Full Defence Engagement was agreed. We reviewed the employment history in detail, prepared the client's formal response to the review, attended the administrative hearing, and subsequently submitted appellate arguments before the review committee. The process took approximately five months in total.
The Outcome
The appellate review determined in the client's favour. Pension entitlement was reinstated in full. The client had been kept informed at each stage and the final outcome was communicated in writing within two days of the decision. "I never felt I was left to navigate this alone."
A client was considering challenging a pension reduction, having heard from others in similar circumstances that an appeal had been worthwhile. They were uncertain whether their own situation warranted the same approach.
Our Approach
During the initial consultation, we reviewed the applicable rules and the client's specific circumstances. Our assessment was that the reduction had been applied correctly, and that a formal challenge was unlikely to alter the outcome. We explained this clearly and honestly.
The Outcome
The client decided not to proceed with a challenge, having received a clear explanation of why the reduction stood. They expressed that the consultation had been valuable: it resolved the uncertainty they had been carrying. This is an outcome we regard as a success. "Knowing was better than not knowing."
